FOLOTOY Privacy Policy

FOLOTOY CREATIVE PTE. LTD. (“FOLOTOY,” “we,” “our,” or “us”) respects your privacy. This Privacy Policy (“Policy”) explains how we collect, use, disclose, and protect information when you use:

  • the FOLOTOY website at https://folotoy.com (“Website”),
  • the FOLOTOY mobile App or browser-based App (“App” or “WebApp”),
  • FOLOTOY AI-powered toys and interactive devices (“Device”),
  • all related features and services (“Services”).

By using the Services, you agree to this Policy. If you do not agree, please discontinue use. Undefined capitalized terms follow definitions described in the FOLOTOY Terms of Service.

1. Information We Collect

We collect information in three ways:

  1. Information you provide to us
  2. Information collected automatically
  3. Information provided by third-party service providers

Some information is required for the proper functioning of the Services. If withheld or deleted, some features may not operate correctly.

A. Information You Provide Directly

You may provide information when you:

  • create an account,
  • set up a Device for your child,
  • interact with Characters or the App,
  • purchase products,
  • contact customer support,
  • participate in promotions or surveys.

This may include:

  • Parent’s email address
  • Parent’s username
  • Payment information (processed via third-party providers)
  • Child’s nickname
  • Child’s birth month/date (optional)
  • Names of family members (optional)
  • User Content submitted to the Services
  • Customer support communications

All identifiable child information is provided only by parents, except information spoken by a child during voice interactions.

B. Audio & Voice Interactions

1.1 Audio Storage

  • Audio is used only for real-time speech-to-text.
  • Audio files are deleted within 24 hours.
  • Audio is not used for training, advertising, or long-term storage.

1.2 Transcriptions

  • Text transcriptions are stored up to 24 hours.
  • Not visible to parents.
  • Not used for training models.
  • Deleted unless required temporarily for safety analysis.

FOLOTOY does not maintain long-term chat histories for children.

C. Information Collected Automatically

We and our service providers may collect:

  • Device identifier
  • Browser and OS details
  • IP address
  • Usage patterns and timestamps
  • Crash logs and diagnostics
  • Approximate location based on IP
  • Connectivity data

Server Logs Retention: Up to 72 hours for debugging, fraud detection, and system integrity. Logs do not include full conversation transcripts.

2. How We Use Information

We use information to:

  • provide and maintain the Services,
  • personalize experiences,
  • improve performance,
  • verify parental access and permissions,
  • ensure safety and compliance,
  • provide customer support,
  • send updates and notifications,
  • detect abuse or fraud.

Use of AI Models

We may send minimal contextual data such as:

  • child’s nickname,
  • child’s general age,
  • other necessary personalization details.

Model providers may include OpenAI, Google, Microsoft, AWS, and future vendors.

These providers do NOT store, train on, or profile FOLOTOY user data.

3. When We Disclose Information

A. Service Providers

For hosting, AI processing, voice features, analytics, support, and payments.

B. Safety, Fraud, Legal Compliance

Including protection of children, fraud prevention, and legal requests.

C. Business Transfers

If FOLOTOY undergoes merger, acquisition, or asset transfer.

D. With Your Consent

When you explicitly grant permission. FOLOTOY does NOT sell personal data.

4. Children’s Privacy (COPPA)

A. Information We Collect About Children

Children may provide:

  • spoken information during interactions
  • data provided by parents during setup
  • voice transcriptions (24 hours max)

B. How We Use Children’s Information

Used for personalization, safety, and device operation. We do NOT:

  • target ads,
  • create behavioral profiles,
  • retain audio longer than 24 hours,
  • train AI models using children’s data.

C. Disclosure of Children’s Information

Only to service providers, legal authorities, or safety-related cases.

D. Parents’ Rights

Parents may request:

  • access,
  • deletion,
  • withdrawal of consent.

E. Parental Access to Chat Data

FOLOTOY does NOT currently provide chat transcript access. If added later, renewed consent and strict controls will be implemented.

5. Data Retention

6. Data Security

We use encryption, access controls, and abuse detection. No system is 100% secure.

7. International Data Transfers

Your data may be processed in the US, Singapore, EU, or other regions.

We implement SCCs and GDPR/PDPA-compliant safeguards.

8. Your Rights

Depending on your jurisdiction, you may request access, deletion, correction, withdrawal of consent, or data portability.

9. Changes to This Policy

We may update this Policy and will modify the Effective Date accordingly.
