FOLOTOY Terms of Service

1. Interpretation and Definitions

Interpretation

Words with initial capital letters have meanings assigned in this section. Definitions apply equally in singular and plural.

Definitions

  • “Application” or “App” means the FOLOTOY mobile application, toy application, or web-based application provided by FOLOTOY CREATIVE PTE. LTD.
  • “Application Store” means the Apple App Store, Google Play Store, or any similar distribution platform.
  • “WebApp” means any browser-based version of FOLOTOY’s Services.
  • “Device” means any device capable of accessing the Services.
  • “Account” means a unique user account required to access the Services.
  • “Parent / Guardian” means an adult supervising a child’s use of the Services.
  • “Content” means any data, text, audio, images, prompts, or materials submitted by you or your child.
  • “Characters” means AI-powered interactive characters created by you or provided by FOLOTOY.
  • “Generations” means AI-generated outputs produced by the Services in response to Content.
  • “In-app Purchases” means purchases of digital goods or features.
  • “Subscription” means recurring paid access plans.
  • “Goods” means physical or digital items available for purchase.
  • “Services” means the Website, App, WebApp, AI interactions, Characters, integrations, and related features.
  • “Website” means https://folotoy.com and its subdomains.
  • “You” means the user or supervising parent/guardian.
  • “Third-Party Content” includes:
    • all user-generated content;
    • content submitted by your child;
    • outputs influenced by prompts or configurations;
    • external content from partners or services.

2. Agreement to Terms

These Terms of Service (“Agreement”) are entered into between you and FOLOTOY CREATIVE PTE. LTD. This Agreement governs your access to the Website and the FOLOTOY App, collectively the “Services.”

By accessing or using the Services, you agree to be bound by this Agreement. If you do not agree, you must stop using the Services.

If using the Services on behalf of a company, you represent you are authorized to bind that entity. “You” includes both you and the entity.

3. Registration and Eligibility

You must provide accurate and current registration information. Individuals under 18 years old may not register or use the Services.

4. Account Security

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. FOLOTOY is not responsible for losses due to failure to secure your account.

5. General Use and Storage Practices

FOLOTOY may establish general usage limits, storage policies, and data retention requirements. FOLOTOY is not liable for deleted or un-stored data.

6. Email Notifications

By providing your email address, you consent to receiving service updates, account notices, and marketing communications.

7. User Conduct

7.1 Prohibited Content

You may NOT submit Content that:

  1. infringes intellectual property rights;
  2. you lack rights to submit;
  3. contains malware or harmful code;
  4. compromises privacy or security;
  5. is abusive, harassing, or violent;
  6. is defamatory or false;
  7. constitutes hate speech;
  8. is obscene or pornographic;
  9. involves sexual harassment;
  10. involves sexual exploitation of minors;
  11. encourages self-harm;
  12. promotes terrorism or extremism;
  13. supports criminal activity;
  14. involves illegal drugs;
  15. provides unlicensed medical, legal, or financial advice;
  16. disrupts the Services;
  17. violates publicity rights;
  18. is otherwise objectionable.

7.2 Prohibited Conduct

You may NOT:

  1. violate applicable laws;
  2. impersonate any person or entity;
  3. collect data without consent;
  4. access unauthorized data;
  5. rent, resell, or sublicense the Services;
  6. bypass security measures;
  7. reverse engineer the Services.

7.3 Voice Features Restrictions

You may not upload third-party voice recordings without consent or use voice features to create impersonations, deepfakes, political misinformation, fraud, or harmful content.

8. Content You Submit

Generations may reflect or be influenced by your prompts, child inputs, or Character configurations. You are responsible for consequences of such outputs.

  • outputs triggered by your content;
  • outputs triggered by your child;
  • outputs influenced by Character settings.

9. Characters & Generations

You are responsible for outputs produced by Characters you configure. This includes cases where parent-submitted content later triggers inappropriate outputs for a child.

Generations are not professional advice and should not be relied upon for decisions related to health, safety, legal matters, finances, or child wellbeing.

10. Services IP & Trademarks

The Services and all related intellectual property belong to FOLOTOY.

The FOLOTOY trademarks may not be used without permission.

Scraping, mining, or bypassing restrictions is strictly prohibited.

11. Third-Party Content

FOLOTOY is not responsible for any third-party content, including Character outputs.

You use such content at your own risk.

12. Repeat Infringer Policy

FOLOTOY may terminate accounts of repeat infringers.

13. Third-Party Links

FOLOTOY does not endorse and is not responsible for third-party websites or services.

14. Disclaimers

FOLOTOY makes no guarantees regarding accuracy or appropriateness of Generations. Outputs may be unpredictable or incorrect. Generations are not professional advice.

15. Limitation of Liability

To the maximum extent permitted by law, FOLOTOY is not liable for indirect, incidental, or consequential damages.

16. Indemnification

You agree to indemnify FOLOTOY for claims arising from your misuse of the Services.

17. Governing Law

This Agreement is governed by the laws of Singapore.

18. Arbitration

All disputes must be resolved through binding individual arbitration.

Class actions are waived.

19. Termination

FOLOTOY may suspend or terminate your access at any time for violations.

20. Parental Responsibility

If your child uses the Services, you agree to supervise and take responsibility for:

  1. the child’s behavior and submissions;
  2. Generations influenced by the child's inputs;
  3. ensuring safe use of the Services.

21. Miscellaneous

If any provision is unenforceable, others remain effective.

FOLOTOY may update this Agreement; continued use means acceptance.

FOLOTOY is not liable for delays caused by events beyond its control, including disasters, war, internet outages, or government actions.
